By accessing or using www.mimipillow.com (the "Site"), reserving a Mimi pillow, or purchasing a product, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site.

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a reservation or purchase. By using the Site you represent that you meet this requirement.
All prices are in U.S. dollars and exclude any applicable taxes and shipping fees, which will be presented at checkout when checkout becomes available. Pricing and product availability may change at any time without notice. Mimi is currently sold out for the first production batch; we maintain a waitlist for the next batch.
When checkout becomes available, your order is accepted only when we send a shipping confirmation. We may decline or cancel any order in our reasonable discretion (for example, suspected fraud, pricing errors, or inability to ship to your address). If we cancel an order you have already paid for, we will issue a full refund.
Estimated shipping times will be displayed at checkout. Risk of loss and title pass to you upon delivery to the carrier.
Returns are governed by our Return Policy. In short: because Mimi makes intimate contact with your face and body, we cannot accept returns once a unit has been opened. Cancellations before shipment are accepted at any time for a full refund.
The Site, the Mimi name and logo, all product designs, photography, written copy, and other materials are owned by Mimi Pillow, Inc. or licensed to us, and are protected by U.S. and international intellectual property laws. You may not copy, reproduce, or distribute them without prior written permission.
You agree not to use the Site for any unlawful purpose, to submit false or misleading information, to attempt to gain unauthorized access to our systems, to scrape or extract data from the Site at scale, or to interfere with the Site's operation. We may suspend or terminate access for violations.
Mimi is a comfort product, not a medical device. We do not diagnose, treat, cure, or prevent any condition. Statements about wellness benefits (such as parasympathetic nervous-system response or improvements in sleep onset) reference general published research on weighted body contact and are not claims that Mimi will produce specific medical outcomes for any individual. If you have a medical condition, consult a qualified healthcare professional.
The Site and the products are provided "as is" and "as available" without warranties of any kind, express or implied, except for any non-disclaimable warranties under applicable law. To the fullest extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Mimi Pillow, Inc. and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any product, even if advised of the possibility of such damages. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Continued use of the Site after a revision constitutes your acceptance of the updated Terms.
If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and Mimi Pillow, Inc.
